Hosting Terms & Service-Level Addendum

This Hosting & Service-Level Addendum ("Addendum") supplements the master services agreement between InfoSpectrum, Inc. ("Provider", "we", "us") and the client named in the associated work order ("Client", "you"). It governs the hosting, maintenance, and traffic limits that apply to websites and applications developed by Provider and hosted on Provider's Cloudflare infrastructure. Capitalized terms not defined here carry the meaning given in our Terms & Conditions.

1. Hosting Scope

Provider will host Client's website or application on Cloudflare Pages, Cloudflare Workers, and/or Cloudflare R2 (collectively, the "Hosting Platform") under Provider's Cloudflare account. Hosting includes:

  • Continuous deployment from the agreed source repository
  • Automatic SSL/TLS certificate provisioning and renewal
  • Global CDN distribution across Cloudflare's edge network
  • Baseline DDoS and WAF protection as provided by Cloudflare
  • Custom domain configuration (one primary domain per hosting plan unless otherwise stated)

2. Complimentary Hosting Period

Where the work order specifies "Free Hosting for 12 Months," Provider will waive the monthly hosting fee for a period of twelve (12) consecutive months beginning on the production launch date of the website. Upon expiry of the complimentary period, Client must elect one of the following:

  • Continue hosting with Provider at the then-current rate for the applicable plan (paid monthly or annually in advance);
  • Migrate the website to a hosting provider of Client's choice, with Provider assisting in a reasonable one-time handover; or
  • Have the website taken offline by Provider.

Provider will notify Client at least thirty (30) days before the complimentary period ends. If Client does not make an election within fifteen (15) days of the period's expiry, hosting will auto-renew on a monthly basis at the then-current rate until Client elects otherwise.

3. Traffic & Usage Limits

Each hosting plan includes the monthly usage limits specified in the work order. The limits associated with each plan tier are reproduced below for reference and may be updated from time to time on the Service Packages page.

"Page views" and "requests" are measured via Cloudflare Analytics. "Form submissions" are measured as successful POST requests to Provider-managed backend endpoints. Measurement periods reset on the first day of each calendar month (UTC).

4. Overage Handling

Provider uses a graduated response to usage that exceeds plan limits. This approach is designed to avoid disruption while protecting shared infrastructure:

  1. 80% of limit (soft warning). Provider emails Client with a usage report and available upgrade options. No service impact.
  2. 100% of limit (first overage in a rolling 90-day window). Provider emails Client a recommended upgrade. Service continues uninterrupted for the remainder of the calendar month.
  3. Second consecutive overage OR sustained overage ≥ 150% of limit. Provider will activate a rate-limiting Cloudflare Worker that serves a Provider-branded "site busy" page to requests exceeding the plan limit, until Client upgrades or the next measurement period begins.
  4. Sustained abuse or infrastructure cost exceeding the plan's economics. Provider reserves the right to throttle or suspend service with 72 hours' written notice. Provider will not suspend service without first offering Client a reasonable upgrade path.

Overage caused by a documented attack (DDoS, scraping, credential stuffing) will not count against Client's limits provided Client notifies Provider promptly and cooperates in mitigation.

5. Upgrades & Downgrades

Client may upgrade to a higher plan at any time, effective immediately; the new rate applies pro-rated for the remainder of the current billing cycle. Downgrades take effect at the start of the next billing cycle. Provider does not refund unused portions of a prepaid annual plan upon downgrade or cancellation, except where required by law.

6. Uptime & Service Levels

Provider targets the following uptime, measured monthly and excluding scheduled maintenance (announced at least 48 hours in advance) and force-majeure events including Cloudflare platform outages:

  • Starter / Business: 99.0% target (no service credits)
  • Professional: 99.5% target; service credits of 5% of monthly fee per full percentage point below target, capped at 50% of monthly fee
  • Enterprise: As specified in the work order, typically 99.9% with defined service credits

Service credits must be requested by Client in writing within thirty (30) days of the incident and are Client's sole remedy for uptime shortfalls.

7. Content Updates & Maintenance

Each plan includes a monthly allowance of content edits as specified in the work order. An "edit" is a discrete change request, such as updating text on one page, swapping one image, or adding one blog post. Edits that require more than thirty (30) minutes of work will be billed separately at Provider's then-current hourly rate or quoted as a mini-project. Unused edits do not roll over.

8. Domain Ownership & Transfer

Where Provider registers a domain on Client's behalf, Provider holds the domain in Provider's Cloudflare account during any complimentary hosting period. Upon Client's election to continue on a paid plan, Provider will transfer the domain to Client's own registrar account within fifteen (15) business days of written request, subject to a handover fee of USD $150 if the request is made during the complimentary period.

9. Data, Backups & Portability

Provider performs weekly backups of Client's database (where applicable) and maintains the last four (4) backup copies. Client may request an export of all Client content, database contents, and source code at any time at no additional charge. Upon termination, Provider will retain Client data for thirty (30) days before permanent deletion.

10. Acceptable Use

Client agrees not to use Provider's Hosting Platform to host content or run workloads that:

  • Violate applicable law or third-party rights;
  • Distribute malware, phishing pages, or fraudulent content;
  • Originate mass unsolicited email or SMS;
  • Run cryptocurrency mining, proxy services, or torrent trackers;
  • Routinely consume more than five (5) times the plan's stated limits (indicating the plan tier is no longer appropriate).

Provider may suspend service immediately, without refund, for material violations of this Section 10.

11. Price Changes

Provider may change the rates for hosting plans with at least sixty (60) days' written notice. Clients on a prepaid annual plan will not be subject to the new rate until their renewal date.

12. Termination

Either party may terminate hosting for any reason with thirty (30) days' written notice. Provider may terminate immediately for non-payment after fifteen (15) days past due, for violations of Section 10, or for repeated sustained overage where Client refuses to upgrade. Upon termination, Sections 8 (Domain Transfer) and 9 (Data & Backups) continue to govern the wind-down.

13. Relationship to Master Agreement

In the event of a conflict between this Addendum and the master services agreement, this Addendum controls with respect to hosting, traffic limits, and service levels. All other terms of the master agreement, including limitation of liability and governing law, remain in full force.
